Every year in January, we present to our readers a summary of the status of The New York Convention (1958), the Washington Convention (1965), and the UNCITRAL Model Law on Arbitration (1985-2006), as of December 31, 2011.
The New York Convention, 1958
As of December 31, 2011, one hundred and forty-six States have signed the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
Liechtenstein ratified the Convention on July 7, 2011; it entered into effect on October 5, 2011. This State will apply the Convention only to recognition and enforcement of awards made in the territory of another contracting State.
There were no other Declarations/Reservations during 2011.
The Washington Convention, 1965
One hundred and fifty-seven States have signed the Washington Convention on the Settlement of Investment Disputes Between States and Nationals of Other States.
Cape Verde ratified the Convention on December 27, 2010; it entered into effect on January 26, 2011. Moldova ratified the Convention on May 5, 2011; it entered into effect on June 4, 2011. The Convention entered into effect in Qatar on January 20, 2011 having been ratified on December 21, 1010.
No State has denounced the Convention in 2011.
A number of States have signed the Convention, but it has not entered into effect to date: Belize, Canada, Dominican Republic, Ethiopia, Guinea Bissau, Kyrgyzstan, Namibia, Russian Federation, Saint Thomas and Principe, and Thailand.
UNCITRAL Model Arbitration Law, 1985
Costa Rica amended its Arbitration Act in 2011 to adopt the 2006 amendments of the 1985 Model Law.
