US Supreme Court Invalidates State Rule That Disfavored Arbitration

Tribunal Supremo EEUU2017 | Agosto 21
The US Supreme Court invalidated a state court rule that had held unenforceable arbitration agreements entered into under broad powers of attorney whenever the powers of attorney did not expressly entitle the representative to enter into an arbitration agreement.

The Court noted that the FAA establishes an equal treatment principle:  a court may invalidate an arbitration agreement based on generally applicable contract defenses, but not on legal rules that apply only to arbitration.  The FAA thus preempts any state rule that discriminates on its face against arbitration.

  1. It really feels like a never ending battle on the part of most states against the FAA.

I am, sometimes, dumbfounded about this apparent tug of war, as the FAA did not intend to push arbitration, but to raise arbitration agreements to a status of a contract as valid as any other contract. Am I off in my understanding?
