If mediation takes place there is no assumption of guilt

A former African National Congress (ANC) MP, Jennifer Ferguson, said on Tuesday, that she reached out to a top South African sports boss offering a “mediated restorative justice” process following allegations that he raped her at a Port Elizabeth hotel 24 years ago.

“I need to state that if mediation takes place there is no assumption of guilt,” Ferguson posted to Facebook on Tuesday.

“A society that laughs at this pathology is betraying its future. We have to find another way. We have decided to formally offer [him] an opportunity for a mediated restorative justice process that would be facilitated by Paul Verryn in consultation with experts in this field.”

  1. That is quite some statement: “if mediation takes place there is no assumption of guilt”.

En español: “Si hay mediación no hay asunción de culpabilidad”.

The alternative this lady suggests to come to terms with unspeakable violence done onto women, onto herself is restorative justice, perhaps a way –the only way?—where the victim and the offender can come to terms with their past and future alongside with us, society.

So, is mediation “fun and games” when it comes to rape, a sort of “shit happened that day” and that’s that? There’s got to be more if only because victims of rape need more than “shit happens”.
